The National Judicial Council has confirmed that one of the judges arrested by the Department of State Security Service (DSS) demanded a bribe of N200million to to tilt the judgment of a case.
The NJC in a statement yesterday where it made known its position on the arrest of Judges said Justice Ladan Tsamiya is culpable of professional misconduct contrary to Code of Conduct for Judicial Officers of the Federal Republic of Nigeria and the provisions of Section 292 of 1999 Constitution of Federal Republic of Nigeria, having demanded a bribe of N200million.
The council however exonerated him from any criminal misconduct because because the Judge only demanded for the bribe, but did not received the money.
For that, the council recommended the compulsory retirement of Justice Tsamiya and recommended him to the president for his action.
“At its Meeting which was held on 29th September,2016, Council had found His Lordship culpable of professional misconduct contrary to Code of Conduct for Judicial Officers of the Federal Republic of Nigeria and the provisions of Section 292 of 1999 Constitution of Federal Republic of Nigeria. Accordingly, he was recommended to MrPresident for compulsory retirement from office following the petition writtenby one MrNnamdi Iro Oji for demanding the sum of N200,000,000.00 (Two Hundred Million Naira) bribe.”
“It is to be stressed that from the evidence before the Council, Hon. Justice Ladan Tsamiya did not receive N200m bribe. The Petitioner adduced evidence to support his allegation that Hon. Justice Tsamiyaonly demanded forthe money.”
“In the exercise of its power, Council had suspended Justice Tsamiyafrom office, pending when the President will act on the recommendation. And Mr. President has approved the recommendation of the Council and compulsorily retired His Lordship from office yesterday, the 12th day of October,2016.”
