Kashamu's Lawyer Submits Fresh Motion To Court

It has been obtained that Buruji Kashamu, has gone further than failing to appearing in court on Monday, May 25, for the proceedings over his extradition to the US.Sahara Reporters provides the exclusive document just submitted to the Federal Hugh Court by the lawyer of the senator-elect, in which they demanded Kashamu’s release from house arrest and for the NDLEA to vacate all his properties.

The National Drug Law Enforcement Agency  laid siege on Kashamu’s residence on May 23, Saturday. On May 25, the politician was ordered to appear in court, which he ignored, saying that the agency had no warrant of arrest as required by the extradition treaty.

His lawyer, Ajibola Oluyede, explained:

“The NDLEA has no warrant to arrest or detain Kashamu, and they have no legal authority to hold him under the Extradition Act. Only a warrant issued by a judge would grant them [NDLEA] the authority for that. They [the NDLEA and Attorney General’s Office] are trying to file a request now.”

The motion served on May 22, now demands that the Attorney General and NDLEA “show cause by a statement of oath within 48 hours…[on] why the court should not find them guilty of criminal contempt as charged in this application.”

The motion states as follows:

“An order directing the Respondents by themselves, their agents, subordinates and officers to release the Applicant unconditionally within 2 hours of the service of this order upon them pending the hearing and determination of the Originating Motion on Notice commencing this committal proceeding.”
